Certificates under the Superannuation and Pensions Act, 1923. |
26.—(1) Whenever the Minister is of opinion that a certificate given or purported to be given under section 1 or section 2 of the Superannuation and Pensions Act, 1923 (No. 34 of 1923), in respect of any person was defective by reason of a misstatement of fact or other error of detail in such certificate or that a certificate under either of the said sections was omitted to be given in respect of any particular person solely through inadvertence and without any negligence or default on the part of such person, the Minister may, at any time within six months after the passing of this Act, give in respect of such person such certificate as is authorised by whichever of the said sections is applicable, and if the Minister states in such certificate that he is of opinion as aforesaid such certificate shall have effect under the appropriate section of the said Superannuation and Pensions Act, 1923 , as if it had been given within six months after the passing of that Act. | |
(2) A certificate may be given under this Act in respect of a person in respect of whom a certificate was given under the Superannuation and Pensions Act, 1923 (No. 34 of 1923), where the cesser of employment which is the subject of the certificate under this Act occurred after the giving of the certificate under the said Superannuation and Pensions Act, 1923 . | ||
(3) Save as is authorised by this section, no certificate shall be given by the Minister under this Act in respect of any person in respect of whom a certificate was given under the Superannuation and Pensions Act, 1923 (No. 34 of 1923). |
