LOCAL GOVERNMENT (TEMPORARY PROVISIONS) ACT, 1923 .

CORK JOINT COUNTY SCHEME.

WHEREAS the Council of the Administrative County of Cork, and the Council of the County Borough of Cork, did, in pursuance of sub-section (2) of Section 3 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act"), prepare a joint scheme in accordance with the provisions of the Act for the relief of the poor in the said County and County Borough, and did submit such Joint Scheme (hereinafter referred to as "the submitted Scheme") to the Minister for Local Government and Public Health (hereinafter referred to as "the Minister");

AND WHEREAS by an Order under his Seal of Office bearing date the 28th day of April, 1924, called the Cork Joint County Scheme Order, 1924, the Minister, in pursuance of Section 4 of the Act, did confirm the submitted scheme with such modifications, omissions and additions as to bring it into conformity with the provisions of the scheme set out in the Schedule to the said Order; and did provide that the scheme as so confirmed should be known as the Cork Joint County Scheme;

AND WHEREAS the Minister, in exercise of the powers conferred on him by Section 5 of the Act did by the Cork County Scheme (Amendment) Order, 1927, amend the Cork Joint County Scheme after it had come into operation;

AND WHEREAS the Minister deems it necessary further to amend and modify the Cork Joint County Scheme in the manner hereinafter appearing;

AND WHEREAS the Minister did give to the Council of the Administrative County of Cork and to the Cork Corporation, one month's notice of his intention to make the said amendments, and has taken into consideration any representation which has been made to him by the said Council and Corporation within such month in respect of the said amendments;

NOW THEREFORE, the Minister, in exercise of the powers given to him by Section 5 of the Act, and of all other powers in this behalf enabling him, the said month having expired, hereby orders as follows, that is to say:—

1. The Cork Joint County Scheme shall be amended and modified in the following manner, that is to say:—

(1) Paragraph (b) of sub-article (1) of Article 4 shall be deleted and a new paragraph (b) substituted as follows:—

"(b) The South County Board shall consist of fifteen members of whom five shall be elected by the Corporation from the members of the Cork City Council and ten shall be elected by the County Council from its members."

2. Sub-article (ii) of Article 4 shall be deleted and a new sub-article substituted as follows:—

"(ii) (a) The Corporation shall elect five members of the Cork City Council to be members of the South County Board at such meeting of the said Council in the year 1932 as the said Council shall decide.

(b) Immediately before the meeting of the Cork City Council at which the election is held in pursuance of the foregoing paragraph of this article the term of office of every member of the South County Board who was elected as such member by the Corporation shall terminate.

(c) Every vacancy in the membership of the South County Board which occurs by reason of the expiration of the term of office of a member of the said Board who was elected by the Corporation shall be filled by the Corporation in the manner in which casual vacancies occurring in the said Board are to be filled by the Corporation.

(d) The term of office of a member of the South County Board who is elected as such member under either paragraph (a) or paragraph (c) of this sub-article, shall be the remainder of his term of office as a member of the Cork City Council."

3. This Order may be cited and referred to as the "Cork County Scheme (Amendment) Order, 1932."
