I, DARRAGH O’BRIEN, Minister for Climate, Energy and the Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021,1 hereby make the following regulations: | ||
Citation | ||
1. These Regulations may be cited as European Union (Data Processing) Regulations 2025. | ||
Definitions | ||
2. (1) In these Regulations— | ||
“European Funds encompassed by the European Union Common Provisions Regulation” means any resources disbursed from the funds encompassed by Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 20211 for the purpose of supporting social and economic development; | ||
“EU Regulation” means Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 20211 ; | ||
“personal data” has the meaning given to it in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 20162 ; | ||
“relevant body” means – | ||
(a) The Minister for Public Expenditure, NDP Delivery and Reform; | ||
(b) A regional assembly established under the Local Government Act 1991 (Regional Assemblies) (Establishment) Order 2014 (S.I. 573/2014); | ||
(c) An institution or body of the European Union; or | ||
(d) Any body designated as a managing authority or an audit authority under the EU Regulation; | ||
“SEAI” means the Sustainable Energy Authority of Ireland; | ||
(2) A word or expression which is used in these Regulations, and which is also used in the EU Regulation, unless the context otherwise requires, has the same meaning in these Regulations as it has in the EU Regulation. | ||
Information sharing | ||
3. (1) SEAI may share data with a relevant body insofar as it is necessary and proportionate for the performance of that relevant body’s functions under the EU Regulation insofar as those functions relate to the provision of European Funds encompassed by the European Union Common Provisions Regulation to SEAI. | ||
(2) The data referred to in subsection (1) shall be any data, including personal data, collected or held by SEAI for the purposes of the administration of any scheme or programme by SEAI. | ||
