I, JIM O’CALLAGHAN, Minister for Justice, Home Affairs and Migration, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Regulation (EU) No 604/20131 of the European Parliament and of the Council of 26 June 2013, hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the European Union (Dublin System) (Amendment) Regulations 2025. | ||
(2) These Regulations shall come into operation on 21 July 2025. | ||
2. Regulation 10 of the European Union (Dublin System) Regulations 2018 ( S.I. No. 62 of 2018 ) is amended – | ||
(a) in paragraph (4), by the substitution of the following subparagraph for subparagraph (b): | ||
“(b) for such period as is necessary to facilitate the transfer of the person which period shall be as short as possible and shall not exceed 42 days from the time of his or her arrest.”, | ||
and | ||
(b) in paragraph (10), by the substitution of the following subparagraph for subparagraph (a): | ||
“(a) in a place listed in Schedule 4, for such period as is necessary to facilitate the transfer of the person which period shall be as short as possible and shall not exceed 42 days from the time of his or her arrest,”. | ||
