S.I. No. 264/2025 - Planning and Development (Prescribed Newspapers) Regulations 2025

I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 2 and 4 (1) of the Planning and Development Act 2024 (No. 34 of 2024), hereby make the following regulations:

Citation

1. These Regulations may be cited as the Planning and Development (Prescribed Newspapers) Regulations 2025.

Definition

2. In these Regulations “Principal Act” means Planning and Development Act 2024 (No. 34 of 2024).

National newspaper

3. (1) The publications set out in the Schedule are prescribed as national newspapers for the purposes of the Principal Act.

(2) For the purposes of paragraph (1), a publication may include an online version of that publication.

Approved local newspaper

4. (1) In considering an approval of a publication circulating in its functional area, an online version of a publication or an online publication as an approved local newspaper, a planning authority shall—

(a) have regard to the level of –

(i) circulation and distribution, or

(ii) readership and accessibility,

as the case may be, of the publication, online version of the publication or the online publication concerned, in the functional area of the planning authority, in order to support, in so far as is reasonable, the availability of notices to be published under the Principal Act, and

(b) include the publication on a list of approved local newspapers maintained by the authority.

(2) Different publications, online versions of publications or online publications may be approved as approved local newspapers for one or more specified parts of the functional area of a planning authority, as the planning authority considers appropriate, having regard to the matters to be considered under paragraph (1) in respect of the part or parts of that functional area.

(3) A planning authority shall—

(a) publish the list referred to in paragraph (1) on its website, and

(b) display a copy of the list in or at the offices of the planning authority and make available copies of the list at those offices during office hours, free of charge.

These Regulations—

• set out a list of publications in the Schedule that are prescribed as national newspapers for the purposes of the Planning and Development Act 2024 , and

• prescribe the manner in which a planning authority approves a local newspaper for the purposes of that Act.
