S.I. No. 177/2025 - Policing, Security and Community Safety Act 2024 (Retirement) Regulations 2025


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 13th May, 2025.

I, MICHEÁL MARTIN, Minister for Justice, in exercise of the powers conferred on me -

(a) by section 254 of the Policing, Security and Community Safety Act 2024 (No. 1 of 2024), having consulted with the Garda Commissioner and the Authority, and

(b) in respect of Regulation 3, by section 261(3) of that Act,

and with the approval of the Government, hereby make the following regulations:

1. (1) These Regulations may be cited as the Policing, Security and Community Safety Act 2024 (Retirement) Regulations 2025.

(2) These Regulations shall come into operation on 17 April 2025.

2. Notwithstanding anything contained in -

(a) the Gárda Síochána (Retirement) Regulations 1934 (S. R. & O. No. 146 of 1934), as continued in force by section 128 of the Garda Síochána Act 2005 and section 261 of the Policing, Security and Community Safety Act 2024 (No. 1 of 2024), or

(b) the Gárda Síochána (Retirement) (No. 2) Regulations 1951 ( S.I. No. 335 of 1951 ), as so continued in force,

the member of An Garda Síochána who, immediately before the coming into operation of these regulations, holds the rank of Garda Commissioner shall retire on 1 September 2025.

3. The Garda Síochána (Retirement) Regulations 2023 ( S.I. No. 397 of 2023 ) are revoked.

The Government hereby approve of the foregoing Regulations.
