S.I. No. 93/2025 - National Transport Authority (Public Passenger Transport Services) (Amendment) Bye-laws 2025

The National Transport Authority, having obtained the prior written consent of the Minister for Transport, in accordance with Section 56A(8) of the Dublin Transport Authority Act 2008 (No. 15 of 2008) to the making of these Bye-laws, in exercise of the powers conferred on it by Section 56A of the Dublin Transport Authority Act 2008 , hereby makes the following Bye-laws. | ||
1. (1) These Bye-laws may be cited as the National Transport Authority (Public Passenger Transport Services) (Amendment) Bye-laws 2025. | ||
(2) The Principal Bye-laws and these bye-laws may be cited together as the National Transport Authority (Public Passenger Transport Services) Bye-laws 2019 and 2025. | ||
(3) These Bye-laws shall come into operation on [ • ] 2025. | ||
2. In these Bye-laws “Principal Bye-laws” means the National Transport Authority (Public Passenger Transport Services) Bye-laws 2019 ( S.I. No. 273 of 2019 ). | ||
3. (1) Bye-law 2 of the Principal Bye-laws is amended in subparagraph (1) by inserting the following after the definition of “Leap Card”: | ||
““omnibus” has the same meaning as it has in Section 3 of the Road Traffic Act 1961 (No. 24 of 1961);”. | ||
(2) Bye-law 7 of the Principal Bye-laws is amended by substituting the following: | ||
“7. A person (with the exception of a responsible person) shall not board or alight from, or attempt to board or alight from a vehicle while it is in motion or, | ||
(a) in the case of an omnibus on a route or portion of a route on which there are stands or stopping places, between bus stops; or | ||
(b) in the case of any vehicle other than an omnibus on a route or portion of a route on which there are stands or stopping places, between places identified by the driver as a departure point or destination point for that person’s trip.”. | ||
(3) Bye-law 31 of the Principal Bye-laws is amended by substituting the following for paragraph (1): | ||
“(1) A person shall not by signal or other indication cause the driver of a vehicle to stop the vehicle except for the purpose of enabling that person to board, or to alight from, the vehicle, | ||
(a) in the case of an omnibus on a route or portion of a route on which there are stands or stopping places, at a bus stop; or | ||
(b) in the case of any vehicle other than an omnibus on a route or portion of a route on which there are stands or stopping places, at a place identified by the driver as a departure point or destination point for that person’s trip.”. | ||

EXPLANATORY NOTE | ||

These Bye-laws apply to bus services provided by certain bus operators on behalf of the National Transport Authority and specify the rules for the boarding and alighting from a large public service vehicle while it is in motion and the rules for signalling or other indications causing the driver of a large public service vehicle to stop the large public service vehicle for the purpose of enabling a person board, or to alight from, the large public service vehicle that apply to omnibus’ on a route or portion of a route on which there are stands or stopping places and the rules for all other large public service vehicles. |
