S.I. No. 760/2024 - Data Protection Act 2018 (Section 159(1))(Amendment) Rules 2024

We, the Superior Courts Rules Committee, constituted pursuant to the provisions of section 67 of the Courts of Justice Act 1936 , and reconstituted pursuant to the provisions of section 15 of the Courts of Justice Act 1953 , by virtue of the powers conferred upon us by section 159 (1) of the Data Protection Act 2018 , do hereby make the following Rules.

Citation and entry into force

1. These Rules, which may be cited as the Data Protection Act 2018 (Section 159(1))(Amendment) Rules 2024, shall come into operation on the 1st day of October 2024.

Interpretation

2. In these Rules, the “Principal Rules” means the Data Protection Act 2018 (Section 159(1)) Rules 2018 (S. I. No. 659 of 2018).

Amendment

3. The Principal Rules are amended by the substitution for paragraphs (f) and (g) of sub-rule (5) of rule 4 of the following paragraphs:

(f) to any person in compliance with an order or direction of a court requiring production or discovery of the personal data concerned;

(g) to a bona fide member of the Press or broadcast media in accordance with rules made under section 159(7) of the 2018 Act, and

(h) to any person authorised by the Sentencing Guidelines and Information Committee, established pursuant to section 23 of the Judicial Council Act 2019 to act on its behalf.”
