S.I. No. 273/2023 - Planning and Development Act (Amendment) Regulations 2023

I, KIERAN O’DONNELL, Minister of State at the Department of Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 231 and 262 (1) of the Planning and Development Act 2000 (No. 30 of 2000) (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )) and by the Housing, Local Government and Heritage (Delegation of Ministerial Functions) Order 2023 ( S.I. No. 116 of 2023 ), hereby make the following regulations:

Citation and construction

1. (1) These Regulations may be cited as the Planning and Development Act (Amendment) Regulations 2023.

(2) These Regulations shall be included in the collective citation the Planning and Development Regulations 2001 to 2023.

Interpretation

2. In these Regulations “Principal Regulations” means the Planning and Development Regulations, 2001 ( S.I. No. 600 of 2001 ).

Amendment to Article 186(1A) of the Principal Regulations

3. Article 186 (1A) of the Principal Regulations is amended by the substitution of “24 month” for “12 month” and by the substitution of “24 months” for “12 months”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the Planning and Development Regulations, 2001 to 2023. They amend the period during which a pre-application consultation meeting under article 184 must take place, involving the person who intends to make an application for an event licence, the local authority and the prescribed bodies. They extend this from during the 12 month period prior to the date of the event to during the 24 month period prior to the date of the event. In the case of an application for a number of events at a venue in a period not exceeding one year, the period is extended from 12 months prior to the holding of the first event to 24 months prior to the holding of the first event.
