S.I. No. 251/2023 - European Union (Planning and Development) (Development for accommodation of Displaced Persons) Regulations 2023

I, RODERIC O’GORMAN, Minister for Children, Equality, Disability, Integration and Youth, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Council Directive 2001/55/EC of 20 July 20011 and giving effect to Council Implementing Decision (EU) 2022/382 of 4 March 20222 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Planning and Development) (Development for Accommodation of Displaced Persons) Regulations 2023.

2. In these Regulations –

“Act of 2000” means the Planning and Development Act 2000 (No. 30 of 2000);

“Council Directive” means Council Directive 2001/55/EC of 20 July 20011 on minimum standards for giving temporary protection in the event of a mass influx of displaced persons and on measures promoting a balance of efforts between Member States in receiving such persons and bearing the consequences thereof;

“Council Implementing Decision” means Council Implementing Decision (EU) 2022/382 of 4 March 20222 establishing the existence of a mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001/55/EC, and having the effect of introducing temporary protection;

“displaced persons” means persons to whom temporary protection applies in accordance with Article 2 of the Council Implementing Decision;

“temporary protection” has the same meaning as it has in the Council Directive.

3. The Act of 2000, other than sections 50, 50A, and 50B, shall not apply to the development described in the Schedule proposed to be carried out, for the purposes of providing accommodation to displaced persons, on behalf of the Minister for Children, Equality, Disability, Integration and Youth.

SCHEDULE

Part 1

Site: Columb Barracks

Address: Ashe Road, Mullingar, Co. Westmeath

Description:

The project involves the supply and installation of 50 modular transitional homes, with a total capacity of 200 people, and associated site development works located in an existing courtyard setting within the campus of Columb Barracks, Ashe Road, Mullingar, Co. Westmeath.

The scope of the project includes the assembly of prefabricated units and associated civil engineering work, comprising the preparation of the existing site to accommodate the modular units, extension of all services infrastructure including new connections to all required utilities, construction of in situ concrete base foundations for the modular units, creation of hardstanding areas throughout the site, formation of new site boundaries and extension of the site lighting. Also included in the project is the provision of semi- mature trees, specimen plants and screening hedges as part of overall landscaping.
