S.I. No. 210/2023 - Road Transport (Operator’s Licence Application) (Amendment) Regulations 2023

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 2 (6) of the Road Traffic and Transport Act 2006 (No. 28 of 2006) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), and for the purposes of giving effect to Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 20201 , hereby make the following regulations: | ||
1. These Regulations may be cited as the Road Transport (Operator’s Licence Application) (Amendment) Regulations 2023. | ||
2. In these Regulations, “Principal Regulations” means the Road Transport (Operator’s Licence Application) Regulations 2018 ( S.I No. 398 of 2018 ). | ||
3. Regulation 2 of the Principal Regulations is amended by the insertion after the definition of “duly accredited person” of the following definition: | ||
“ ‘EU Regulation’ means Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 20092 as amended by Commission Regulation (EU) No 613/2012 of 9 July 20123 , Council Regulation (EU) No 517/2013 of 13 May 20134 and Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 20201 ;”. | ||
4. The Principal Regulations are amended in Regulation 6 – | ||
(a) in paragraph (d), by the substitution of “the EU Regulation” for “Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009”, and | ||
(b) in paragraph (g), by the insertion of “with appropriate equipment and facilities” after “premises”. | ||
5. Schedules 1 and 2 to the Principal Regulations are amended by the insertion under “Transport Manager Details” of the following additional details: | ||
“NUMBER OF EMPLOYEES | ||
Number of Employees on 31 December of the previous year”. | ||

These Regulations amend the Road Transport (Operator’s Licence Application) Regulations 2018 ( S.I. No. 398 of 2018 ) to require a road transport operator to provide to the Minister for Transport the number employees employed by the operator on 31 December of the previous year. | ||
