S.I. No. 209/2023 - European Union (International Road Haulage Market) (Amendment) Regulations 2023

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 2nd May, 2023.

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purposes of giving effect to Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 20201 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (International Road Haulage Market) (Amendment) Regulations 2023.

2. In these Regulations, “Principal Regulations” means the European Union (International Road Haulage Market) Regulations 2011 ( S.I No. 698 of 2011 ).

3. Regulation 2 of the Principal Regulations is amended by the substitution of the following definition for the definition of “EU Regulation”:

“ ‘EU Regulation’ means Regulation (EC) No 1072/2009 of the European Parliament and of the Council of 21 October 20092 as amended by Commission Regulation (EU) No 612/2012 of 9 July 20123 , Council Regulation (EU) No 517/2013 of 13 May 20134 and Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 20201 ;”.

4. Regulation 7 of the Principal Regulations is amended by the insertion of “and a member of the Garda Síochána” before “is an authorised inspecting officer”.

These Regulations amend the European Union (International Road Haulage Market) Regulations 2011 ( S.I. No. 698 of 2011 ) to take account of Regulation (EU) 2020/1055 of 15 July 2020, which amended Regulation (EC) No 1072/2009 with a view to adapting it to developments in the road transport sector.
