S.I. No. 196/2023 - Oireachtas (Allowances) (Amendment) Regulations 2023

I, PASCHAL DONOHOE, Minister for Public Expenditure, National Development Plan Delivery and Reform, in exercise of the powers conferred on me by section 3 (4) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1992 (No. 3 of 1992), and the Finance (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 418 of 2011 ), and the Public Expenditure and Reform (Alteration of Name of Department and Title of Minister) Order 2023 ( S.I. No. 19 of 2023 ) hereby make the following regulations:

1. (1) These regulations may be cited as the Oireachtas (Allowances and Facilities) (Amendment) Regulations 2023.

(2) These regulations come into operation on 26 April 2023.

2. The Oireachtas (Allowances and Facilities) Regulations ( S.I. No. 84 of 2010 ) is amended by inserting after Regulation 11 the following:

“11A. Allowance in respect of security measures

(1) Where a member of either House of the Oireachtas incurs expenses in enhancing the security of their staff, home or offices, for the purpose of safely performing the member’s parliamentary duties, the Clerk of Dáil Éireann shall pay on a once-off basis to the member a sum not exceeding €5,000, or 50% of their total costs, whichever is the lesser, in final settlement of the expenses, (“security requirements allowance”) following receipt of claim for the expenses.

(2) A claim for payment of a sum under this Regulation shall be made to the appropriate authority in such form and contain such particulars as the Oireachtas Commission from time to time directs.”
