S.I. No. 180/2023 - Education (Delegation Of Ministerial Functions) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 11th April, 2023.

The Government, on the request of the Minister for Education and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Education (Delegation of Ministerial Functions) Order 2023.

2. The powers and duties of the Minister for Education conferred on her by or under the provisions of the enactments specified in the Schedule are delegated to Josepha Madigan, Minister of State at the Department of Education.

SCHEDULE

Paragraph (a) of section 7 (1) of the Education Act 1998 (No. 51 of 1998), in so far as that paragraph relates to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Subsections (3) and (4) of section 7 of the Education Act 1998, in so far as those subsections relate to the performance of the other functions under that Act delegated by this order

Section 33(i) and (j)(iv) of the Education Act 1998, in so far as those provisions relate to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Section 37A (as substituted by section 6 of the Education (Provision in Respect of Children with Special Educational Needs) Act 2022 (No. 22 of 2022)) of the Education Act 1998

Sections 21, 22 and 28 of, and Schedule 1 to, the Education for Persons with Special Educational Needs Act 2004 (No. 30 of 2004)
