S.I. No. 125/2023 - Education Support Centres (Appointment and Secondment of Directors) (Amendment) Regulations 2023

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 28th March, 2023.

I, NORMA FOLEY, Minister for Education, in exercise of the powers conferred on me by section 37 (6) of the Education Act 1998 (No. 51 of 1998) (as adapted by the Education and Skills (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 450 of 2020 )), hereby make the following regulations:

1. These Regulations may be cited as the Education Support Centres (Appointment and Secondment of Directors) (Amendment) Regulations 2023.

2. In these Regulations, “Regulations of 2017” means the Education Support Centres (Appointment and Secondment of Directors) Regulations 2017 ( S.I. No. 394 of 2017 ).

3. Regulation 5 of the Regulations of 2017 is amended by the insertion of the following paragraph after paragraph (5):

“(5A) Any allowance payable, as part of the terms and conditions relating to remuneration determined by the Minister in accordance with paragraph (4), to a person appointed on or after 1 September 2017 as a Director of an education support centre shall be payable to the person for so long only as he or she stands appointed as such a Director.”.

4. Regulation 6 of the Regulations of 2017 is amended –

(a) in paragraph (1), by the substitution of “Subject to paragraph (1A), where the appointment” for “Where the appointment”, and

(b) by the insertion of the following paragraph:

“(1A) Paragraph (1) shall not apply in respect of the appointment of a Director for a school year where the continued appointment of the Director was approved by the Minister –

(a) in accordance with paragraph (1) for the 4 consecutive years immediately prior to that school year, or

(b) in accordance with –

(i) paragraph (1) for the 3 consecutive years immediately prior to that school year, and

(ii) paragraph (10) for the year immediately prior to those 3 consecutive years.”.

5. Regulation 11(6) of the Regulations of 2017 is amended by the substitution of “10 consecutive years” for “5 consecutive years”.
