S.I. No. 2/2023 - Statistics (Producer Prices Survey) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 13th January, 2023.

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), and for the purpose of giving full effect to Article 6(1)(a) and (b) and (2)(j) of Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 20191 as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 20212 , hereby order as follows:

1. This Order may be cited as the Statistics (Producer Prices Survey) Order 2023.

2. (1) In this Order –

“Act of 1993” means the Statistics Act 1993 (No. 21 of 1993);

“monthly reference day” has the meaning assigned to it by Article 6;

“quarter” means a period of 3 months ending on 31 March, 30 June, 30 September or 31 December in any year;

“quarterly reference day” has the meaning assigned to it by Article 7;

“Regulation” means Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 20191 as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 20212 ;

“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20063 as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 20084 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20125 and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 20196 ;

“survey” means the Producer Prices Survey that is conducted by the Central Statistics Office for the purposes of obtaining information set out in the Schedule for the purposes of compliance with the Regulation, in so far as it relates to Annexes I to V thereto.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. A requirement on an undertaking that is classified for statistical purposes under section B (other than class 7.21 or division 9), C (other than division 18 or 33, class 24.46 or group 25.4, 30.1, 30.3 or 30.4) or D of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 to provide for the purposes of the survey the information specified in paragraphs 1(a), (c) and 2 of the Schedule is hereby prescribed.

4. A requirement on an undertaking that is classified for statistical purposes under –

(a) section B (other than class 7.21), C (other than class 24.46 or group 25.4, 30.1, 30.3 or 30.4) or D or division 36, or

(b) section G (other than division 47), H, I, J, K, L, M, N, P, Q, R or S,

of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 to provide for the purposes of the survey the information specified in paragraphs 1(b), (c) and 2 of the Schedule is hereby prescribed.

5. A requirement on an undertaking that is classified for statistical purposes under section F of NACE Rev. 2 set out in Annex I to Regulation (EC) No. 1893/2006 to provide for the purposes of the survey the information set out in paragraphs 1(d) and 2 of the Schedule is hereby prescribed.

6. The undertakings in relation to which a requirement to provide information is prescribed in Article 3 or 4(a) shall provide the information referred to in Article 3 or 4(a), as the case may be, in relation to the 15th day of each month (in this Order referred to as the “monthly reference day”) in the period from January 2023 to December 2027, monthly in relation to the immediately preceding monthly reference day.

7. The undertakings in relation to which a requirement to provide information is prescribed in Article 4(b) or 5 shall provide the information referred to in Article 4(b) or 5, as the case may be, in relation to the 15th day of the second month in each quarter (in this Order referred to as the “quarterly reference day”) in the period from 1 January 2023 to 31 December 2027, quarterly in relation to the immediately preceding quarterly reference day.

8. The Statistics (Producer Prices Survey) Order 2019 ( S.I. No. 566 of 2019 ) is revoked.

SCHEDULE

Articles 3, 4 and 5

1. Information regarding the following, as it relates to the undertaking concerned, and specifying the monthly reference day or quarterly reference day, as the case may be, to which the information relates:

(a) the purchase price of goods or services purchased in or outside the State by the undertaking;

(b) the sale price of goods or services sold in or outside the State by the undertaking;

(c) the following particulars in respect of the goods and services referred to in subparagraph (a) or (b), as the case may be:

(i) a description of the goods or services;

(ii) the terms of purchase or sale, as the case may be, of the goods or services;

(iii) the country of purchase or sale, as the case may be, of the goods or services;

(iv) the discount or surcharges applied to the purchase or sale, as the case may be, of the goods or services;

(v) the currency of purchase or sale, as the case may be, of the goods or services;

(d) the sale price of materials sold in or outside the State by the undertaking.

2. Information on the time taken by the undertaking concerned to complete the form, questionnaire or other record prepared by the Director General for the collection of the information referred to in paragraph 1.
