S.I. No. 394/2022 - Maritime Area Planning Act 2021 (Commencement of Certain Provisions) (No. 2) Order 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 2nd August, 2022.

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 1 (5) of the Maritime Area Planning Act (No. 50 of 2021), hereby order as follows:

1. This Order may be cited as the Maritime Area Planning Act 2021 (Commencement of Certain Provisions) (No. 2) Order 2022.

2. The 31st day of July 2022 is appointed as the day on which the following provisions of the Maritime Area Planning Act 2021 (No. 50 of 2021) shall come into operation:

(a) Part 1, other than sections 6 and 12,

(b) Chapter 4 of Part 9, and

(c) Schedules 2, 3, 4, 5, 6 and 9.

EXPLANATORY NOTE

(This note is not part of the legal instrument and does not purport to be a legal interpretation)

This Order appoints 31 July 2022 as the date on which

• Part 1 (other than sections 6 and 12),

• Chapter 4 of Part 9, and

• Schedules 2, 3, 4, 5, 6 and 9

of the Maritime Area Planning Act 2021 (No. 50 of 2021) comes into operation.

Chapter 4 amends provisions of the Electricity Regulation Act 1999 to facilitate ownership by the transmission system operator of certain transmission system assets and its commencement enables necessary amendments to the European Communities (Internal Market in Electricity) Regulations 2000 ( S.I. No. 445 of 2000 ).

The Maritime Area Planning Act 2021 (Commencement of Certain Provisions) Order 2022 (S.I. No. 112/2022) appointed 10 March 2022 as the day on which the following provisions of the Maritime Area Planning Act 2021 (No. 50 of 2021) came into operation:

(a) section 72;

(b) Part 4 (other than Chapter 12); and

(c) Part 6.
