S.I. No. 145/2022 - Health Insurance (Amendment) Act 2021 (Commencement) Order 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 1st April, 2022.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 9 (2)(b) of the Health Insurance (Amendment) Act 2021 (No. 47 of 2021), hereby order as follows:

1. This Order may be cited as the Health Insurance (Amendment) Act 2021 (Commencement) Order 2022.

2. The 1st day of April 2022 is appointed as the day on which the Health Insurance (Amendment) Act 2021 (No. 47 of 2021), other than paragraphs (b) and (c) of section 5 and insofar as that Act is not already in operation, shall come into operation.

EXPLANATORY NOTE

This Order appoints 1 April 2022 as the date on which the provisions of the Health Insurance (Amendment) Act 2021 which concern the operation of the new Risk Equalisation Scheme come into effect. Those provisions concern the introduction of high cost claim credits to the operation of the Scheme, and of a new benchmark for reasonable profit for the purpose of the overcompensation test.
