S.I. No. 535/2021 - Student Support (Amendment) Regulations 2021


Notice of the making of this Statutory Instrument was published in

I, SIMON HARRIS, Minister for Further and Higher Education, Research, Innovation and Science, in exercise of the powers conferred on me by sections 4 , 7 , 8 and 14 and 14A(1) of the Student Support Act 2011 (No. 4 of 2011), and the Further and Higher Education, Research, Innovation and Science (Transfer of Departmental Administration and Ministerial Functions) Order 2020 ( S.I. No 451 of 2020 ), having consulted with the Higher Education Authority and with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations:—

Citation and Commencement

1. These Regulations may be cited as the Student Support (Amendment) Regulations 2021.

2. These Regulations shall be deemed to have come into operation on the 20th day of October 2021.

Definition

3. In these Regulations “Principal Regulations” means the Student Support Regulations 2021 ( S.I. No. 132 of 2021 )

Amendment of Schedule 1 of the Principal Regulations

4. Schedule 1 to the Principal Regulations is amended in PART A thereof, by the insertion of the following approved institution:

“Technological University of the Shannon: Midlands and Midwest”

Amendment of Article 5 of the Principal Regulations

5. Article 5 of the Principal Regulations is amended by the insertions of the following article:

“5(4) A child of a Turkish national in respect of whom the Minister for Justice has granted a permission to reside and who, in accordance with Article 9 of Decision 1/80 of the Association Council made pursuant to the Ankara Agreement 1963, is residing with their parents, who are or have been legally employed within the State and can satisfy the conditions relating to employment laid down in Articles 6 and 7 of Decision 1/80.”

The Minister for Public Expenditure and Reform consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

These Regulations are an amendment to the existing principal Regulations ( S.I. No. 132 of 2021 ) which prescribe “approved institutions” and other matters for the purposes of the Student Support Act 2011 . These Regulations may be cited as the Student Support (Amendment) Regulations 2021.
