S.I. No. 385/2020 - Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2020


Notice of the making of this Statutory Instrument was published in

I, Eamon Ryan, Minister for Transport, in exercise of the powers conferred on me by section 5 of the Road Traffic Act 1961 (No. 24 of 1961) and section 17 of the Road Traffic Act 2010 (No. 25 of 2010) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2020.

(2) These Regulations come into operation on 1 October 2020.

2. The Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) Regulations 2011 ( S.I. No. 540 of 2011 ) are amended –

(a) by the substitution of the following Regulation for Regulation 5:

“5. The form set out in Part 2 of Schedule 2 is the prescribed form of certificate for the purposes of section 17 of the Act of 2010 to certify-

(a) the presence of a drug or drugs, and

(b) the concentration of a drug or drugs.”,

(b) by the deletion of Regulation 6 (inserted by Regulation 2(a) of the Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2017 ( S.I. No. 151 of 2017 )),

and

(c) in Schedule 2, by the substitution for Part 2 and Part 3 (inserted by Regulation 2(b) of the Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2017 of the text set out in the Schedule.
