S.I. No. 511/2019 - Industrial Training (Geoscience Industry) Order 2019


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 18th October, 2019.

An tSeirbhís Oideachais Leanúnaigh agus Scileanna, after making such inquiries as it thinks proper and consultation with organisations and associations appearing to it to be representative of substantial numbers of employers in the activities referred to in this Order and of substantial numbers of persons employed in such activities, in exercise of the powers conferred on it by section 23 of the Industrial Training Act 1967 (No. 5 of 1967) and by section 38 of the Further Education and Training Act 2013 (No. 25 of 2013) hereby makes the following Order:

1. This Order may be cited as the Industrial Training (Geoscience Industry) Order 2019.

2. The following activities are hereby declared to be designated industrial activities for the purposes of the Industrial Training Act 1967 (No. 5 of 1967):

(a) the drilling of holes in the earth’s surface for the purpose of, or in connection with, the obtaining of samples from, or the investigation of, the subsurface;

(b) the extraction of samples from the subsurface for the purpose of, or in connection with, scientific evaluation, site investigation, mineral exploration, groundwater extraction, mine drilling operations, the harnessing of geothermal energy or the routing of utilities through inclined boreholes;

(c) the testing of samples derived from the subsurface;

(d) the preparation of boreholes to be charged with explosives for the purposes of blasting activities in quarries and mines; and

(e) the installation of monitoring equipment for the purpose of, or in connection with, any of activities at sub-paragraphs (a) to (d).

3. In this Order:

“explosive” means Class 1 explosives as classified in the manual published by the United Nations Organisation and entitled “Fifteenth Revised Edition of the Recommendations prepared by the United Nations Committee of Experts on the Transport of Dangerous Goods” (ISBN 92-1-139120-6) or a later edition thereof that is in substitution for, and not an alternative to, that edition; and

“subsurface” means all matter under the earth’s surface, including but not limited to soil, minerals, groundwater and bedrock.

An tSeirbhís Oideachais Leanúnaigh agus Scileanna was established under the Further Education and Training Act 2013 to promote training in industry and commerce.

This Order defines the activities of the geoscience industry in relation to which An tSeirbhís Oideachais Leanúnaigh agus Scileanna shall exercise its functions in the creation of statutory apprenticeships.
