S.I. No. 508/2019 - Adoption Act 2010 (Abridged Certificate) Regulations 2019

I, REGINA DOHERTY, Minister for Employment Affairs and Social Protection, in exercise of the powers conferred on me by section 89 of the Adoption Act 2010 (No. 21 of 2010), following consultation with the Minister for Children and Youth Affairs (pursuant to article 3 and the Schedule of the Office of the Minister for Children and Youth Affairs (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 218 of 2011 )), and with the consent of the Minister for Public Expenditure and Reform (pursuant to article 3 and Schedule 1 of the Finance (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 418 of 2011 )), hereby make the following regulations:

Citation

1. These Regulations may be cited as the Adoption Act 2010 (Abridged Certificate) Regulations 2019.

Commencement

2. These Regulations come into operation from the date of signature.

Interpretation

3. In these Regulations –

“Abridged Certificate” means, as respects an entry in the Adopted Children Register, a certificate of the items set out in the Schedule to these Regulations endorsed in the manner set out in the said Schedule.

“uncertified copy” (of an Abridged Certificate) means a copy of the items set out in the Schedule to these Regulations that is not endorsed in the manner set out in the said Schedule.

Prescribed fees

4. (1) An tArd-Chláraitheoir shall issue an Abridged Certificate to any applicant on payment of a fee of €20.

(2) An tArd-Chláraitheoir shall issue an uncertified copy of an Abridged Certificate to any applicant on payment of a fee of €4.

Form of application

5. (1) In order to allow an tArd-Chláraitheoir to issue an Abridged Certificate, or an uncertified copy, the application shall contain as many as possible of the following particulars:

(a) the forename,

(b) the date and country of birth,

(c) the name, address and occupation of the adopter or adopters,

(d) the date of the adoption order.

(2) The fact that any of the information specified in Regulation 5(1) of these Regulations is not furnished shall not be a valid reason for an tArd-Chláraitheoir to refuse to issue an Abridged Certificate, or an uncertified copy, if he or she is satisfied that the appropriate entry can be identified.

Revocation

6. The Adoption Act 2010 (Abridged Certificate) Regulations 2011 ( S.I. No. 611 of 2011 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The effect of this Order is:

• to allow for the issue of an Abridged Certificate, containing specified particulars, from a register of adoptions maintained by an tArd-Chláraitheoir,

• to extend the list of particulars to include details of “parent(s)” as well as details of “mother” and “father”,

• to increase the fee to be charged for the issue of such Abridged Certificates to €20, in line with fees for other similar certificates, and

• to make provision for an uncertified copy, for a fee of €4, in line with fees for other similar uncertified copies.
