I, Michael Creed, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving further effect to Council Regulation (EC) No. 21/2004 of 17 December 20031 as amended by Council Regulation (EC) No 1791/2006 of 20 November 20062 , Council Regulation (EC) No 1560/2007 of 17 December 20073 , Commission Regulation (EC) No 933/2008 of 23 September 20084 , Commission Regulation (EC) No 759/2009 of 19 August 20095 , Commission Regulation (EU) No 506/2010 of 14 June 20106 , Commission Implementing Regulation (EU) No 45/2012 of 19 January 20127 and Council Regulation (EU) No 517/2013 of 13 May 20138 and Commission Regulation (EC) No 1505/2006 of 11 October 20069 as amended by Commission Regulation (EU) No 1033/2010 of 15 November 201010 and Commission Decision 2006/968/EC of 15 December 200611 as amended by Commission Decision 2008/337/EC of 24 April 200812 and Commission Decision 2010/280/EU of 12 May 201013 in so far as they relate to animals of the ovine species, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Sheep Identification) (Amendment) Regulations 2019.

(2) These Regulations come into operation on 1 June 2019.

2. In these Regulations “principal Regulations” means the European Communities (Sheep Identification) Regulations 2011 ( S.I. No. 309 of 2011 ).

3. Regulation 2 of the principal Regulations is amended –

(a) by substituting for the definition of “Council Regulation” the following:

“‘Council Regulation’ means Council Regulation (EC) No. 21/2004 of 17 December 2003 as amended by Council Regulation (EC) No. 1791/2006 of 20 November 2006, Council Regulation (EC) No. 1560/2007 of 17 December 2007, Commission Regulation (EC) No. 933/2008 of 23 September 2008, Commission Regulation (EC) No. 759/2009 of 19 August 2009, Commission Regulation (EU) No. 506/2010 of 14 June 2010, Commission Implementing Regulation (EU) No 45/2012 of 19 January 2012 and Council Regulation (EU) No 517/2013 of 13 May 2013;”,

(b) by substituting for the definition of “Minister” the following:

“‘Minister’ means Minister for Agriculture, Food and the Marine;”,

(c) by substituting for the definition of “slaughter ear-tag” the following:

“‘slaughter ear-tag’ means an EID tag used as a means of identification of a sheep approved by the Minister and conforming with point 7 of Section A of the Annex to the Council Regulation;”,

(d) by substituting for the definition of “Sheep identification legislation” the following:

“‘Sheep identification legislation ’ means Council Regulation (EC) No. 21/2004 of 17 December 2003 as amended by Council Regulation (EC) No. 1791/2006 of 20 November 2006, Council Regulation (EC) No. 1560/2007 of 17 December 2007, Commission Regulation (EC) No. 933/2008 of 23 September 2008, Commission Regulation (EC) No. 759/2009 of 19 August 2009, Commission Regulation (EU) No. 506/2010 of 14 June 2010, Commission Implementing Regulation (EU) No 45/2012 of 19 January 2012 and Council Regulation (EU) No 517/2013 of 13 May 2013 and Commission Regulation (EC) No. 1505/2006 of 11 October 2006 as amended by Commission Regulation (EU) No. 1033/2010 of 15 November 2010 and Commission Decision 2006/968/EC of 15 December 2006 as amended by Commission Decision 2008/337/EC of 24 April 2008 and Commission Decision 2010/280/EU of 12 May 2010;”.

EXPLANATORY NOTE

These Regulations amend the European Communities (Sheep Identification) Regulations 2011 ( S.I. No. 309 of 2011 ) in the context of the extension of EID to all sheep moving from any holding with effect from 1st June 2019.
