S.I. No. 220/2019 - European Parliament Elections (Amendment) Act 2019 (Commencement) (No. 2) Order 2019


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th May, 2019.

I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in exercise of the powers conferred on me by section 9 (4) of the European Parliament Elections (Amendment) Act 2019 (No. 7 of 2019), hereby order as follows:

1. This Order may be cited as the European Parliament Elections (Amendment) Act 2019 (Commencement) (No. 2) Order 2019.

2. The 22nd day of May 2019 is appointed as the day on which the following provisions of the European Parliament Elections (Amendment) Act 2019 (No. 7 of 2019) shall come into operation:

(a) subsections (c) and (d) of section 4;

(b) subsections (h), (i) and (j) of section 6.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Order brings into operation sections 4 (c), 4 (d), 6 (h), 6 (i) and 6 (j) of the European Parliament Elections (Amendment) Act 2019 . These provisions amend the European Parliament Elections Act 1997 to provide: -

- that the holders of certain posts that are incompatible with membership of the European Parliament would cease to hold such posts upon taking up their seats in the European Parliament; and

- for an amendment to the count and notification rules to provide for an order of election in the constituencies of Dublin and South to determine the two persons who would not take up their seats in the European Parliament until such time as the date of the United Kingdom’s withdrawal from the European Union has become legally effective.
