S.I. No. 44/2018 - European Union (Measuring Instruments) (Revocation) Regulations 2018

I, HEATHER HUMPHREYS, Minister for Business, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2011/17/EU of the European Parliament and of the Council of 9 March 20111 , hereby make the following regulations:

Citation and commencement

1. (1) These Regulations may be cited as the European Union (Measuring Instruments) (Revocation) Regulations 2018.

(2) These Regulations come into operation on 28 February 2018.

Revocation

2. The following Regulations are revoked:

(a) Regulations 2(a), 6(1) and 8 of, and Schedule 4 to, the European Communities (Measuring Instruments) Regulations 1973 ( S.I. No. 67 of 1973 );

(b) European Communities (Weights and Measures of Length) Regulations 1975 ( S.I. No. 200 of 1975 );

(c) European Communities (Standard Mass per Storage Volume of Grain) Regulations 1976 ( S.I. No. 111 of 1976 );

(d) European Communities (Cold-Water Meters) Regulations 1977 ( S.I. No. 320 of 1977 );

(e) European Communities (Measuring Instruments) Regulations 1977 ( S.I. No. 328 of 1977 );

(f) European Communities (Measurement of Alcoholic Strength) Regulations 1979 ( S.I. No. 187 of 1979 );

(g) European Communities (Tyre Pressure Gauges for Motor Vehicles) Regulations 1988 ( S.I. No. 175 of 1988 ).

Transitional Arrangements

3. (1) Notwithstanding paragraphs (a) and (b) of Regulation 2, a weight described in—

(a) the Annexes to Council Directive 71/317/EEC of 26 July 1971 on the approximation of the laws of the Member States relating to 5 to 50 kilogramme medium accuracy rectangular bar weights and 1 to 10 kilogramme medium accuracy cylindrical weights2 , or

(b) the Annex to Council Directive 74/148/EEC of 4 March 1974 on the approximation of the laws of the Member States relating to weights of from 1 mg to 50 kg of above-medium accuracy3 ,

may be subject to initial verification in accordance with Regulations 15 to 18 of the European Communities (Measuring Instruments and Metrological Control) Regulations 2018 ( S.I. No. 43 of 2018 ) until 30 November 2025.

(2) Nothing in these Regulations shall invalidate an EC pattern approval or an EC pattern approval certificate issued prior to 30 November 2015 under—

(a) the Regulations referred to in paragraphs (c), (d), (f) or (g) of Regulation 2, or

(b) the law of another Member State giving effect to—

(i) Council Directive 71/347/EEC of 12 October 1971 on the approximation of the laws of the Member States relating to the measuring of the standard mass per storage volume of grain4 ,

(ii) Council Directive 75/33/EEC of 17 December 1974 on the approximation of the laws of the Member States relating to cold-water meters5 ,

(iii) Council Directive 76/765/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to alcoholometers and alcohol hydrometers6 , or

(iv) Council Directive 86/217/EEC of 26 May 1986 on the approximation of the laws of the Member States relating to tyre pressure gauges for motor vehicles7 .

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations give further effect to Directive 2011/17/EU of the European Parliament and of the Council of 9 March 2011.

These Regulations come into operation on 28 February 2018.

A number of Statutory Instruments concerning measuring instruments are revoked under Regulation 2.

Transitional Arrangements are provided for in Regulation 3 for certain measuring instruments.
