S.I. No. 28/2018 - Garda Síochána Act 2005 (Retirement) Regulations 2018

I, CHARLES FLANAGAN, Minister for Justice and Equality, in exercise of the powers conferred on me by paragraph (h) (as amended by section 43(m) of the Criminal Justice Act 2007 (No. 29 of 2007)) of section 122(1) (as amended by section 56(a) of the Garda Síochána (Policing Authority and Miscellaneous Provisions) Act 2015 (No. 49 of 2015)) of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 138 of 2011 )), after consulting with the Garda Commissioner and the Policing Authority and with the approval of the Government, hereby make the following regulations:

1. These Regulations may be cited as the Garda Síochána Act 2005 (Retirement) Regulations 2018.

2. Subject to section 4 of the Public Service Superannuation (Miscellaneous Provisions) Act 2004 (No. 7 of 2004) and notwithstanding the Garda Síochána (Retirement) Regulations 1934 ( S. R. & O., No. 146 of 1934 ) and the Garda Síochána (Retirement) (No. 2) Regulations 1951 ( S.I. No. 335 of 1951 ), a person appointed to the rank of Commissioner after the commencement of these Regulations shall retire—

(a) on completion of 5 years’ service in that rank, or

(b) on attaining the age of 60 years,

whichever is the earlier.

3. The Garda Síochána (Retirement) Regulations 1990 ( S.I. No. 318 of 1990 ) are revoked.

The Government hereby approve of the foregoing Regulations.
