I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2016/317 of 3 March 2016¹ and further effect to 2004/842/EC: Commission Decision of 1 December 2004² (as amended by Commission Implementing Decision (EU) 2016/320 of 3 March 2016³ ), hereby make the following regulations:

1. These Regulations may be cited as the European Union (Cereal Seed) (Amendment) Regulations 2017.

2. The European Union (Cereal Seed) Regulations 2013 ( S.I. No. 217 of 2013 ) are amended in Regulation 2(1) by substituting for the definition of “Directive” (as amended by the European Union (Cereal Seed) (Amendment) Regulations 2016 ( S.I. No. 375 of 2016 )) the following:

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation)

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2016/317 of 3 March 2016 which amends Council Directive 66/402 as regards the official label of seed packages

These Regulations also give effect to Commission Implementing Decision (EU) 2016/320 of 3 March 2016 amending Decision 2004/842/EC concerning implementing rules whereby Member States may grant an authorization to place on the market seed belonging to varieties for which an application for entry in the national catalogues of varieties of agricultural plant species or vegetable species has been submitted.
