I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2016/317 of 3 March 20161 and further effect to 2004/842/EC: Commission Decision of 1 December 20042 (as amended by Commission Implementing Decision (EU) 2016/320 of 3 March 20163 ), hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Beet Seed) (Amendment) Regulations 2017. | ||
2. The European Communities (Beet Seed) Regulations 2001 ( S.I. No. 142 of 2001 ) are amended by substituting- | ||
(a) in Regulation 2(1) for the definition of “EC Directive” (as amended by the European Communities (Beet Seed) (Amendment) Regulations 2005 ( S.I. No. 919 of 2005 )) the following: | ||
“‘Directive’ means Council Directive 2002/54/EC of 13 June 20024 , (as amended by Council Directive 2003/61/EC of 18 June 20035 , Council Directive 2004/117/EC of 22 December 20046 Commission Implementing Directive (EU) 2016/317 of 3 March 2016) and 2004/842/EC: Commission Decision of 1 December 2004 (as amended by Commission Implementing Decision (EU) 2016/320 of 3 March 2016);”, and | ||
(b) in Regulation 18 for subparagraph (ii) the following: | ||
“(ii) The European Communities (Beet Seed) (Amendment) Regulations, 1988 ( S.I. No 52 of 1988 )”. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2016/317 of 3 March 2016 which amends Council Directive 2002/54 as regards the official label of seed packages | ||
These Regulations also give effect to Commission Implementing Decision (EU) 2016/320 of 3 March 2016 amending Decision 2004/842/EC concerning implementing rules whereby Member States may grant an authorization to place on the market seed belonging to varieties for which an application for entry in the national catalogues of varieties of agricultural plant species or vegetable species has been submitted. | ||
