I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purposes of giving effect to Directive 2009/103/EC of the European Parliament and of the Council of 16 September 20091 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Motor Insurance) (Limitation of Insurance in relation to Injury to Property) Regulations 2016.

2. Section 56 (2) of the Road Traffic Act 1961 (No. 24 of 1961) is amended by the substitution of the following paragraph for paragraph (a):

"(a) it may, in so far as it relates to injury to property, be limited to the sum of €1,220,000 per claim, whatever the number of victims,".

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations give legal effect to the provisions of Directive 2009/103/EC of the 16th September 2009 (codified version) relating to insurance against civil liability in respect of the use of motor vehicles, and the enforcement of the obligation to insure against such liability.

The Regulations provide for:

the limit per claim for property damage being raised from €1,120,000.00 to €1,220,000.00 regardless of the number of victims.
