I, SIMON COVENEY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2008/98/EC of the European Parliament and of the Council of 19 November 20081 on waste and repealing certain Directives, hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Union (Waste Directive) (Amendment) Regulations 2016.

Interpretation

2. In these Regulations—

“Act of 1996” means the Waste Management Act 1996 (No. 10 of 1996);

“Principal Regulations” means the European Communities (Waste Directive) Regulations 2011 ( S.I. No. 126 of 2011 );

“Waste Directive” means Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives.

Amendment of Regulation 14 of the Principal Regulations

3. Regulation 14 of the Principal Regulations is amended-

(a) by inserting the following after regulation 14(b):

“(c) by substituting the following for subsection 3(b):

“(b) Regulations under this section may include provisions for the imposition of producer responsibility obligations on producers of products including provisions requiring the producer of a specified product to partly or wholly bear the waste management costs of that product and or the sharing of these costs with the distributors of such specified products.””

(b) by inserting the following regulation 14(d):

“(d) by inserting the following after subsection 3(b):

“(c) In order to maximise environmental benefits, including the environmentally sound management of products at their end of life, regulations under this section may also include provisions for the application of economic instruments including the making of arrangements relating to the display of environmental management charges, at a specified rate, by a producer or distributor as appropriate, to the purchasers of specified products.””

These Regulations amend the European Communities (Waste Directive) Regulations 2011, ( S.I. No. 126 of 2011 ), in order to give further effect to those provisions of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste which promotes the use of economic instruments in a progressive manner to drive resource efficiency and support the management of waste in accordance with the waste hierarchy.
