S.I. No. 224/2016 - Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (Duration of Part 2) Order 2016.

I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 (2) of the Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (No. 27 of 2007) (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 245 of 2011 )), and having received requests from the Irish Congress of Trade Unions and the Irish Business and Employers Confederation in accordance with that section, and being satisfied that the continued operation of Part 2 of that Act would be conducive to the continued orderly conduct of industrial relations, hereby order as follows:

1. This Order may be cited as the Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (Duration of Part 2) Order 2016.

2. The period mentioned in subsection (1) of section 3 of the Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (No. 27 of 2007), as extended by the Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (Duration of Part 2) Order 2013 ( S.I. No. 153 of 2013 ), is extended by a further period of 3 years commencing on the expiration of the period provided for by Statutory Instrument No. 153 of 2013.

EXPLANATORY NOTE

(This Note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of this Order is to extend, by a further 3 years until 7 May 2019, the period for which Part 2 of the Protection of Employment (Exceptional Collective Redundancies and Related Matters) Act 2007 (No. 27 of 2007) shall have effect. This Part of the Act allows for case referrals to the Redundancy Panel in instances where proposed redundancies are considered to constitute exceptional collective redundancies as defined in the Act. This Part of the Act also sets out the process and procedure to be followed in pursuing referrals to the Panel.
