S.I. No. 13/2015 - Water Services (No. 2) Act 2013 (Property Vesting Day) Order 2015.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 16th January, 2015.

I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 12 (1) of the Water Services (No. 2) Act 2013 (No. 50 of 2013), hereby make the following order:

1. This Order may be cited as the Water Services (No. 2) Act 2013 (Property Vesting Day) Order 2015.

2. In this Order—

“the Act” is the Water Services (No. 2) Act 2013 (No. 50 of 2013);

“accessories” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“land” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“pipe” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“sewer” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“storm water sewer” has the meaning assigned by the Water Services (No. 2) Act 2013 (No. 50 of 2013);

“waste water works” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“water main” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007);

“water services authority” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007); and

“waterworks” has the meaning assigned by the Water Services Act 2007 (No. 30 of 2007).

3. The 20th of January 2015 is appointed as a “property vesting day” for the purposes of section 12 of the Act.

4. On the property vesting day referred to in article 3, the following property, which immediately before this day was vested in a water services authority, and used or intended to be used by a water services authority in connection with the water services functions transferred to Irish Water by section 7 of the Act, shall stand vested in Irish Water:

(i) all water mains and sewers (other than storm water sewers) and any related accessories; and

(ii) all pipes, waterworks and waste water works that are located under land, along with any related accessories.

This Statutory Instrument gives effect to the decision of the Minister for the Environment, Community and Local Government to transfer the property listed in the Order from each water services authority to Irish Water in accordance with section 12 of the Water Services (No. 2) Act 2013 .
