S.I. No. 501/2014 - African Swine Fever (Restriction on Movements of Pigs and Pig Products) Regulations 2014.

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013) and for the purpose, inter alia, of giving full effect to Commission Implementing Decision No. 2014/709/EU of 9 October 20141 , hereby make the following regulations:

1. These Regulations may be cited as the African Swine Fever (Restriction on Movements of Pigs and Pig Products) Regulations 2014.

2. (1) In these Regulations “Commission Decision” means Commission Implementing Decision No 2014/709/EU of 9 October 2014.

(2) A word or expression that is used in the Commission Decision and that is also used in these Regulations has, in these Regulations, the same meaning as in the Commission Decision.

3. A person shall not move into the State–

(a) live pigs originating in an area listed in Parts 1, II, III and IV of the Annex to the Commission Decision, except in accordance with Article 8(2) and 8(3) of the Commission Decision,

(b) porcine semen, ova or embryos originating in an area listed in Parts II, III and IV of the Annex to the Commission Decision, except in accordance with Article 9 of the Commission Decision,

(c) pig meat, pig meat preparations, pig meat products or any other products containing pig meat originating in an area listed in Parts11, III or IV of the Annex to the Commission Decision, except in accordance with Article 13 of the Commission Decision,

(d) an animal by-product derived from a pig originating in an area listed in Parts II, III and IV of the Annex to the Commission Decision, except in accordance with Article 10 of the Commission Decision,

4. A person shall not have in his or her possession or under his or her control, sell or supply a pig, pig semen, ova, embryo, pig meat, pig meat preparations, pig meat products or an animal by-product derived from a pig that has been brought into the State in contravention of Regulation 3.

5. Regulations 3 and 4 are penal provisions to which section 36 (4)(b) of the Animal Health and Welfare Act 2013 applies.

6. The European Communities (African Swine Fever) (Restrictions on Imports from Sardinia) Regulations 2007 (SI 131 of 2007) are repealed.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations give effect to Commission Implementing Decision 2014/709/EU of 9 October 2014 to require that no live pigs or pig products are brought into the Union from the areas (in Eastern Europe and Sardinia) affected by African Swine fever except in accordance with the Decision.
