I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive No. 2008/122/EC of the European Parliament and of the Council of 14 January 20091 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Protection of Consumers in respect of Timeshare, Long-term Holiday Product, Resale and Exchange Contracts) (Amendment) Regulations 2014.

2. Regulation 17 of the European Union (Protection of Consumers in respect of Timeshare, Long-term Holiday Product, Resale and Exchange Contracts) Regulations 2011 (No. 73 of 2011) is amended, in paragraph (3), by the substitution of “receives a request from the trader to make” for “makes”.

These Regulations amend Regulation 17(3) of the European Union (Protection of Consumers in respect of Timeshare, Long-term Holiday Product, Resale and Exchange Contracts) Regulations 2011( S.I. No. 73 of 2011 ) which give effect to European Parliament and Council Directive No. 2008/122/EC on the protection of consumers in respect of certain aspects of timeshare, long-term holiday product, resale and exchange contracts1 .

The purpose of the amendment is to ensure the consumer’s right to terminate a long-term holiday product contract after receiving a request for the second instalment payment.
