S.I. No. 358/2014 - Nursing and Midwifery Board of Ireland Rules Pursuant to the Provisions of Sections 64(3)(c) of the Nurses and Midwives Act 2011 Regarding the Receiving and Recording of Evidence by the Fitness to Practise Committee.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 1st August, 2014.

1. Pursuant to the provisions of Section 64 (3)(c) of the Nurses and Midwives Act, 2011 :

1. 1 The Fitness to Practise Committee may receive evidence of witnesses given by means of live video link, a video recording, sound recording or any other mode of transmission.

1. 2 The Fitness to Practise Committee will only receive recorded evidence after considering submissions by or on behalf of the registered nurse or midwife and/or the Chief Executive Officer as to the appropriateness of such evidence. The Fitness to Practise Committee will make a ruling on such submissions.

1. 3 Any expenses incurred in respect of live video link evidence of witnesses called by or on behalf of the registered nurse or midwife, the subject of the Inquiry, shall be the responsibility of the registered nurse or midwife.

2. 1 These rules will be published in the prescribed manner as defined in Section 2 of the Nurses and Midwives Act, 2011 .

The Minister for Health in exercise of the powers conferred on him by section 13 (7) of the Nurses and Midwives Act, 2011 , approved the making of the above rules on the 17th day of July, 2014.
