S.I. No. 290/2014 - European Union (Protection of Animals at the Time of Killing) (Amendment) Regulations 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th June, 2014.

I, Simon Coveney, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving further effect to Council Regulation (EC) No 1099/2009 of 24 September 20091 hereby make the following regulations:

1. These Regulations may be cited as the European Union (Protection of Animals at the Time of Killing)(Amendment) Regulations 2014.

2. The European Union (Protection of Animals at the Time of Killing) Regulations 2013 ( S.I. No. 292 of 2013 ) are amended—

(a) by substituting the following for Regulation 18(1)-

“18.(1) Where an animal satisfies the conditions set out in the definition of emergency killing at Article 2(d) of the Council Regulation-

(a) and the conditions in Article 1.2 of the Council Regulation apply, the keeper shall act in accordance with Articles 3.1, 3.2 and 19 of the Council Regulation,

(b) in all other cases, the business operator shall act in accordance with Chapters II and III and Article 19 of the Council Regulation.”, and

(b) in Regulation 21 by deleting paragraphs (9) and (10).

These Regulations clarify the existing rules on emergency killing to confirm that emergency killing in slaughterhouses are subject to the general rules and the provisions for emergency killing. The Regulations also remove the provisions on arrest without warrant for breaching the Regulations.
