S.I. No. 94/2014 - European Union (Citizens' Initiative) (Amendment) Regulations 2014.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving full effect to Regulation (EU) No 211/2011 of the European Parliament and of the Council of 16 February 2011, as amended by Commission Delegated Regulation (EU) No 887/2013 of 11 July 2013, and Commission Implementing Regulation (EU) No 1179/2011 of 17 November 2011, hereby make the following Regulations:

1. These Regulations may be cited as the European Union (Citizens’ Initiative) (Amendment) Regulations 2014.

2. The European Union (Citizens’ Initiative) Regulations 2012 ( S.I. No.79 of 2012 ) and these Regulations shall be construed as one and may be cited together as the European Union (Citizens’ Initiative) Regulations 2012 and 2014.

3. Regulation 5(1) and the Schedule to the European Union (Citizens’ Initiative) Regulations 2012 are revoked.

4. Regulation 5(2) of the European Union (Citizens’ Initiative) Regulations 2012 is amended by substituting for paragraph (c) the following:

“(c) notify any signatory that their statement of support will be certified unless the signatory indicates to the Competent Authority before the expiry of a specified period of time that they are not a signatory or that they are not eligible to be a signatory.”

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend the European Union (Citizens’ Initiative) Regulations 2012 ( S.I. No.79 of 2012 ) by revoking the statement of support form for use in Ireland, set out in the Schedule to those regulations. The form for use in Ireland will be the Statement of Support Form — Part A, as set out in Annex II of Commission Delegated Regulation (EU) No 887/2013 of 11 July 2013. The regulations also modify the nature of the correspondence that may arise between the Competent Authority and a signatory of a statement of support.
