S.I. No. 88/2014 - Nursing and Midwifery Board of Ireland Rules Specifying Criteria to be Considered For Applications for Restoration to the Register.

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 21st February, 2014.

Rules pursuant to the provisions of Section 79 (2)(d) of the Nurses and Midwives Act, 2011 . hereby order the following Regulations:

1. Criteria for the Board when considering whether to restore the registration of a nurse or midwife whose registration has been cancelled.

1. 1 The circumstances that led to cancellation of the nurse’s or midwife’s registration.

1. 2 The findings of the Fitness to Practise Committee and the reasons relied on by the Board for their decision to cancel the nurse’s or midwife’s registration.

1. 3 Whether the nurse or midwife has gained any insight into the matters that led to the cancellation of her/ his registration.

1. 4 What the nurse or midwife has done since cancellation of her/his registration.

1. 5 The steps taken by the nurse or midwife to keep her/his nursing or midwifery knowledge up to date.

1. 6 The steps that have been taken by the nurse or midwife to rehabilitate professionally and/or socially.

1. 7 Any evidence relevant to the nurse’s or midwife’s fitness to practise.

2. 1 These Rules will be published in the prescribed manner as defined in Section 2 of the Nurses and Midwives Act, 2011 .

The Minister for Health in exercise of the powers conferred on him by section 13 (7) of the Nurses and Midwives Act, 2011 , approved the making of the above rules on the 14th day of February 2014.
