S.I. No. 358/2013 - Companies Act 1963 and Irish Bank Resolution Corporation Act, 2013 (Statement of Affairs) (Amendment) Order 2013.

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 20th September, 2013.

I, MICHAEL NOONAN, Minister for Finance, pursuant to and in accordance with Section 224 (1) of the Companies Act 1963 (as such provision applies in modified form to the special liquidation of Irish Bank Resolution Corporation Limited pursuant to Section 10 of the Irish Bank Resolution Corporation Act 2013 (No. 2 of 2013)), having regard to the purposes of that Act and the public interest in ensuring the orderly winding up of Irish Bank Resolution Corporation Limited, hereby order as follows:

1. This Order may be cited as the Companies Act 1963 and Irish Bank Resolution Corporation Act, 2013 (Statement of Affairs)(Amendment) Order 2013.

2. —(1) In these Regulations, unless the context otherwise requires—

“Order of 2013” means the Companies Act 1963 and Irish Bank Resolution Corporation Act 2013 (Statement of Affairs) Order 2013 (S.I. 304 of 2013).

(2) A word or expression that is used in this Order and is also used in the Order of 2013 shall have the same meaning as it has in the Order of 2013 unless the contrary intention appears.

3. The reference to “Irish Bank Resolution Limited” in the third line of the Order of 2013 is amended by the substitution of “Irish Bank Resolution Corporation Limited”.

4. Rule 3 of the Order of 2013 is amended by:

(a) the deletion of the word “and” in paragraph (b);

(b) the substitution for “.” in paragraph (c) of “;”;

(c) the insertion of the following new paragraph:

“(d) the Statement of Affairs and the Schedule of the trade or other creditors to be attached to the Statement of Affairs shall not include particulars of the names or addresses or any other personal details of any person who, at the Relevant Date, held deposits with the Company.”
