S.I. No. 243/2013 - Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 3) (Credits) Regulations 2013.

I, JOAN BURTON, Minister for Social Protection, in exercise of the powers conferred on me by sections 4 and 33 of the Social Welfare Consolidation Act 2005 (No. 26 of 2005) (adapted by the Social and Family Affairs (Alteration of Name of Department and Title of Minister) Order 2010 ( S.I. No. 186 of 2010 )), hereby make the following Regulations:

Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 3) (Credits) Regulations 2013.

(2) These Regulations and the Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 to 2013 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 to 2013.

Commencement.

2. These Regulations come into operation on 4 July 2013.

Credits in respect of periods of receipt of jobseeker’s allowance in certain circumstances.

3. Article 58(1)(c) of the Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 ( S.I. No. 312 of 1996 ) is amended by substituting “, jobseeker’s allowance payable to a person to whom section 148A of the Act of 2005 applies or one-parent family payment where, immediately prior to claiming such allowance or payment,” for “or lone parent’s allowance where immediately prior to claiming the said allowance”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

Section 10 of the Social Welfare and Pensions (Miscellaneous Provisions) Act 2013 provides for amendments to the Jobseeker’s Allowance scheme to cater for the transition of persons to that scheme who no longer qualify for One-Parent Family Payment due to their youngest child reaching specified age thresholds (to be known as Jobseeker’s Allowance Transition).

These Regulations provide for the award of credited contributions to recipients of Jobseeker’s Allowance Transition where they had been receiving another social welfare payment immediately before claiming Jobseeker’s Allowance Transition and had been entitled to have credited contributions awarded while in receipt of that social welfare payment.
