I, JAMES REILLY, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Implementing Regulation (EU) No. 91/2013 of 31 January 20131 and giving further effect to Commission Regulation (EC) No. 669/2009 of 24 July 20092 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) (No. 2) Regulations 2013.

2. Regulation 2(1) (as amended by the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) Regulations 2013 ( S.I. No. 59 of 2013 )) of the European Communities (Official Controls on the Import of Food of Non-Animal Origin) Regulations 2010 ( S.I. No. 391 of 2010 ) is amended—

(a) in the definition of “designated point of entry (DPE)”, by substituting “European Economic Area” for “European Union”, and

(b) by substituting for the definition of “EC Regulation 669/2009” the following—

“‘EC Regulation 669/2009’ means Commission Regulation (EC) No. 669/2009 of 24 July 20092, as amended by Commission Regulation (EU) No. 212/2010 of 12 March 20103 , Commission Implementing Regulation (EU) No. 1235/2012 of 19 December 20124 and Commission Implementing Regulation (EU) No. 91/2013 of 31 January 20131.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations give partial effect to Commission Implementing Regulation (EU) No. 91/2013 of 31 January 2013 laying down specific conditions applicable to the import of groundnuts from Ghana and India, okra and curry leaves from India and watermelons seeds from Nigeria and amending Regulations (EC) No. 669/2009 and (EC) No. 1152/2009.

These Regulations amend the European Communities (Official Controls on the Import of Food of Non-Animal Origin) Regulations 2010 ( S.I. No. 391 of 2010 ) in the manner specified in these Regulations.

These Regulations may be cited as the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) (No. 2) Regulations 2013.
