I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive 2010/60/EU of 30 August 20101 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Marketing of Seeds) (Amendment) Regulations 2011.

2. The European Communities (Marketing of Seeds) Regulations 2009 ( S.I. No. 431 of 2009 ) are amended by substituting, in Regulation 2, the definition of “Commission Directive” (as amended by the European Communities (Marketing of Seeds) (Amendment) Regulations 2010 ( S.I. No. 531 of 2010 ) for the following—

“ ‘Commission Directive’ means Commission Directive 2008/62/EC of 20 June 20082 , Commission Directive 2009/145/EC of 26 November 20093 and Commission Directive 2010/60/EU of 30 August 2010;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations provide for derogations in relation to the marketing of preservation mixtures from the requirements of the Council Directive 66/401/EEC on the marketing of fodder plant seed and give effect to Commission Directive 2010/60/EU. Preservation mixtures of fodder plant seed are intended for recreation of the flora of natural and semi-natural habitats. These Regulations specify requirements for the production and marketing of such mixtures.
