I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by sections 5 , 10 , 11 and 14 of the Local Government (Charges) Act 2009 , hereby make the following regulations:_

Citation

1. These Regulations may be cited as the Local Government (Charges) Regulations 2011.

Commencement

2. These Regulations come into operation on 1 January 2012.

Interpretation

3. (1) In these Regulations, “Act” means the Local Government (Charges) Act 2009 .

(2) A reference in these Regulations to a section shall, unless the context otherwise requires, be deemed to be a reference to a section of the Act.

Fee for purposes of section 5(4)

4. A fee of €10 is prescribed for the purposes of section 5(4).

Fees and expenses

5. The fees and expenses to which section 10(4) applies are those which relate to functions being carried out or to be carried out in the administration and development of services for the collection of the charge.

Prescribed persons

6. Each of the following is a prescribed person for the purposes of section 11(1)(c):

(a) the Local Government Computer Services Board established by the Local Government Computer Services Board (Establishment) Order 1975 ( S.I. No. 212 of 1975 ); and

(b) the Local Government Management Services Board established by the Local Government Management Services Board (Establishment) Order 1996 ( S.I. No. 410 of 1996 ).

EXPLANATORY NOTE

These Regulations specify a fee of €10 for attending at the offices of a local authority for the purposes of payment of a non-principal private residence charge. They also provide for the fees and expenses payable to certain boards for the carrying out of functions under the Act. The Regulations also provide for data sharing and exchange between the bodies specified.
