S.I. No. 411/2010 - Education and Skills (Delegation of Ministerial Functions) Order 2010.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 30th July, 2010.

The Government, on the request of the Tánaiste and Minister for Education and Skills and in exercise of the powers conferred on them by section 2(1) of the Ministers and Secretaries (Amendment) (No.2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Education and Skills (Delegation of Ministerial Functions) Order 2010.

2. The powers (other than the power to prosecute an offence) and duties of the Tánaiste and Minister for Education and Skills, conferred on her by or under—

(a) the Youth Employment Agency Act 1981 (No. 32 of 1981),

(b) the Industrial Training Act 1967 (No. 5 of 1967),

(c) the Labour Services Act 1987 (No. 15 of 1987) (other than in so far as it relates to the following):

(i) section 3(2);

(ii) the functions of An Foras Áiseanna Saothair referred to in paragraphs (b) to (g) of section 4(1);

(iii) section 6;

(iv) Schedule 1,

(d) the National Training Fund Act 2000 (No. 41 of 2000),

(e) section 7(1)(c)(i) of the Education Act 1998 (No. 51 of 1998), in so far as it relates to adult education, including educational disadvantage (within the meaning of that Act) among adults,

(f) section 7(1)(c)(ii) of the Education Act 1998 , in so far as it relates to transport services, and

(g) the Education (Welfare) Act 2000 (No. 22 of 2000) (other than section 36 and the Schedule),

are delegated to Seán Haughey, Minister of State at the Department of Education and Skills.
