S.I. No. 283/2009 - Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2009


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 28th July, 2009.

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by sections 5 and 70 of, and rule 4(f)(iii) of the Third Schedule to, the Seanad Electoral (Panel Members) Act 1947 (No. 42 of 1947) and section 11 of the Seanad Electoral (Panel Members) Act 1954 (No. 1 of 1954), hereby makes the following Regulations:—

1. These Regulations may be cited as the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2009.

2. The Seanad Electoral (Panel Members) (Prescribed Forms) Regulations 1954 ( S.I. No. 91 of 1954 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 1972 ( S.I. No. 202 of 1972 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2000 ( S.I. No. 291 of 2000 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2002 ( S.I. No. 68 of 2002 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2007 ( S.I. No. 116 of 2007 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) (No. 2) Regulations 2007 ( S.I. No. 191 of 2007 ), the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) (No. 3) Regulations 2007 ( S.I. No. 231 of 2007 ) and these Regulations shall be construed as one and may be cited together as the Seanad Electoral (Panel Members) (Prescribed Forms) Regulations 1954 to 2009.

3. The Seanad Electoral (Panel Members) (Prescribed Forms) Regulations 1954 are amended by—

(a) the deletion in Article 2A(i) (as inserted by Article 3(a) of the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2002) of the words “or Seanad bye-election”;

(b) the substitution for form No. 21 in the Schedule to the said Regulations (as inserted by Article 3(b) of the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2002) by form No. 21 in the Schedule hereto;

(c) the substitution for form No. 27 in the Schedule to the said Regulations by form No. 27 in the Schedule hereto.

4. The Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2002 are amended by the substitution in the first line of Article 3(b) of the words “form No. 9” for “forms No. 9 and 21” and by the substitution in the second line of the said article of the words “form No. 9” for “forms No. 9 and 21”.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

These Regulations amend the Seanad Electoral (Panel Members) (Prescribed Forms) Regulations 1954 and the Seanad Electoral (Panel Members) (Prescribed Forms) (Amendment) Regulations 2002. They prescribe the ballot paper form for use at Seanad bye-elections and a revised form of the covering envelope to be used by an elector when returning voting documents in bye-elections to the Seanad Returning Officer.
