S.I. No. 113/2007 - Electoral Act 1997 (Limitation and Reimbursement of Election Expenses at Dáil Election) Order 2007


Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 16th March, 2007.

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by section 3 of the Electoral Act 1997 (No. 25 of 1997), hereby orders as follows:-

1. This order may be cited as the Electoral Act 1997 (Limitation and Reimbursement of Election Expenses at Dáil Election) Order 2007.

2. The amount of election expenses which may be reimbursed to a candidate under section 21 of the Electoral Act 1997 , as provided for in subsection (1)(b)(i) of that section, shall be the actual expenses incurred by the candidate or €8,700, whichever is the less.

3. The aggregate of election expenses which may be incurred by or on behalf of a candidate in connection with his or her candidature at a Dáil election, as provided for in section 32 (1)(a)(i), (ii) and (iii) of the Electoral Act 1997 , shall not exceed €30,150, €37,650 and €45,200 respectively.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This order varies, in line with changes in the Consumer Price Index, the maximum amounts of expenditure which may be incurred by or on behalf of a candidate in a Dáil election to €30,150 in a 3-seat constituency; €37,650 in a 4-seat constituency; and €45,200 in a 5-seat constituency. It also provides, in line with the changes in the Consumer Price Index, that the amount of election expenses which may be reimbursed to a candidate at a Dáil election is the actual expenses or €8,700, whichever is the less.
