S.I. No. 67/2007 - Abattoirs Act 1988 (Veterinary Examination and Health Mark) Regulations 2007


Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 23rd February, 2007.

WHEREAS Commission Regulation No. 2073/2005, in Article 8, provides for a derogation as regards compliance with certain standards subject to certain conditions;

AND WHEREAS it is necessary to provide in national legislation rules over and above those provided for in that Regulation and in the European Communities Food and Feed Hygiene Regulations 2005 ( S.I. No. 910 of 2005 );

NOW I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 39 and 40 of the Abattoirs Act 1988 (No.8 of 1988), hereby make the following Regulations—

1. These Regulations may be cited as the Abattoirs Act 1988 (Veterinary Examination and Health Mark) Regulations 2007 and cease to have effect on 31 December 2009.

2. (1) A person may sell or supply minced meat, a meat preparation or a meat product, intended to be eaten cooked-

(a) if the minced meat, meat preparation or meat product is clearly and legibly labeled or marked-

(i) in accordance with the Schedule, and

(ii) that the product must be thoroughly cooked prior to consumption, and,

(b) he or she holds, in respect of the establishment where the minced meat, meat preparation or meat product is prepared, a consent issued under Regulation 17B (inserted by the European Communities (Food and Feed Hygiene) (Amendment) Regulations 2007 ( S.I. No. 56 of 2007 )) of the European Communities (Food and Feed Hygiene) Regulations 2005 ( S.I. No. 910 of 2005 ).

(2) A person shall not export minced meat, a meat preparation or meat product to which paragraph (1) applies.

(3) A person shall not mark minced meat, a meat preparation or meat product to which paragraph (1) applies with the mark referred to in Article 5 of Regulation (EC) No. 853/2004 of the European Parliament and of the Council of 29 April 2004 1 .

(4) The following are revoked-

(a) Abattoirs Act 1988 (Veterinary Examination) Regulations 1992 ( S.I. No. 89 of 1992 ),

(b) Abattoirs (Health Mark) Regulations 1992 ( S.I. No. 90 of 1992 ),

(c) Abattoirs Act 1988 (Veterinary Examination) (Amendment) Regulations 1997 ( S.I. No. 425 of 1997 ),

(d) Abattoirs Act 1988 (Veterinary Examination) (Amendment) Regulations 1998 ( S.I. No. 6 of 1998 ),

(e) Abattoirs Act 1988 (Veterinary Examination) (Amendment) (No. 2) Regulations 1998 ( S.I. No. 512 of 1998 ),

(f) Abattoirs Act 1988 (Veterinary Examination) (Amendment) Regulations 1999 ( S.I. No. 327 of 1999 ),

(g) Abattoirs Act 1988 (Veterinary Examination) (Amendment) Regulations 2002 ( S.I. No. 165 of 2002 ), and

(h) Abattoirs Act 1988 (Veterinary Examination) (Amendment) (No. 3) Regulations 2003 ( S.I. No. 278 of 2003 ).

Regulation 2(1).

SCHEDULE

The special mark shall consist of a rectangle where each horizontal side is twice the length of each vertical side and shall have clearly and legibly marked the approval number of the establishment to which the mark relate, the word “IRELAND” and the letter N in the same proportions as in the model that follows:

These Regulations are made under the Abattoirs Act 1988 to take account of the derogation contained in Article 8 of Commission Regulation (EC) No. 2073/2005. A number of previous regulations made under the Abattoirs Act 1988 are revoked.
