S.I. No. 15/2007 - Railway (Dublin Light Rail Line A - Tallaght to Abbey Street) (Amendment) Order 2007


I, Martin Cullen, Minister for Transport, in exercise of the powers conferred on me by section 43(7)(a) of the Transport (Railway Infrastructure) Act 2001 (No. 55 of 2001) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 (S.I. No. 305 of 2002)) on the application of the Railway Procurement Agency and being of the opinion that said application should be granted and being also of the opinion that the rights in over or under public roads specified in this Order are , with the consent of the Minister for the Environment, Heritage and Local Government, necessary for giving effect to the following Order, hereby order as follows:

1.          This Order may be cited as the Railway (Dublin Light Rail Line A - Tallaght to Abbey Street) (Amendment) Order 2007.

2.          In this Order—

“No. 2 Order of 2004” means the Transport (Railway Infrastructure) Act 2001 (Line A - Tallaght to Abbey Street Light Railway) (Amendment) (No. 2) Order 2004 (S.I. No. 256 of 2004);

“Principal Order” means the Transport (Dublin Light Rail) Act 1996 (Line A - Tallaght to Abbey Street Light Railway) Order 1999 (S.I. No. 59 of 1999).

3.          Article 16 (as amended by the Transport (Railway Infrastructure) Act 2001 (Line A - Tallaght to Abbey Street Light Railway) (Amendment) (No. 3) Order 2004) of the Principal Order is amended by inserting the following after paragraph (1):

“(1A)(a)         Notwithstanding paragraph (1), in the case of the railway works authorised by virtue of the amendments to this Order by the Railway (Dublin Light Rail Line A - Tallaght to Abbey Street) (Amendment) Order 2007, the construction of those works shall be completed within the period of 3 years beginning on 31 January 2007.

(b)         The authorised works to which subparagraph (a) relates shall not be read so as to affect the continued operation, maintenance and improvement of the light railway pending completion of those works.”.

4.  (1)     Part 1 of the First Schedule to the Principal Order is amended -

(a)      under Area 2 by substituting the following for “Work No. 3” and the description of that work:

“Work No. 3

A light railway approximately 313 metres in length consisting of double lines of light railway commencing at match line B and running in a westerly direction and turning in a northerly direction to the north of the existing depot for the light railway and ending at match line C as shown on Plan No. RO 2 B - C Revision A.”,

(b)      under Area 2 by substituting the following for “Work No. 4” and the description of that work (as amended by the No. 2 Order of 2004):

“Work No. 4

A light railway approximately 318 metres in length consisting of double lines of light railway commencing at match line C and running in an easterly direction over the Western Parkway Motorway through the intersection of the Western Parkway Motorway with the Naas Road and ending on the Naas Road at the intersection of the Naas Road with Turnpike Road at match line O as shown on Plan No. RO 2 C - O Revision B.”,

and

(c)      under Area 3 by substituting the following for “Work No. 1” and the description of that work (as amended by the No. 2 Order of 2004):

“Work No. 1

A light railway approximately 153 metres in length consisting of double lines of light railway commencing at the intersection of the Naas Road with Turnpike Road at match line O and running in an easterly direction to match line A as shown on Plan No. RO 3 O - A Revision B.”.

(2)     Part 2 of the First Schedule to the Principal Order is amended-

(a)      under Area 2 by substituting the following for “Work No. 3” and the description of that work:

“Work No. 3

Construct a stop to be called “Red Cow stop” in the location shown on Plan No. RO 2 B - C Revision A and remove the present stop.”,

and

(b)      under Area 2 by substituting the following for “Work No. 4” and the description of that work:

“Work No. 4

Construct a car parking area in the location shown on Plan No. RO 2 B - C Revision A and alter the layout of the present car parking area accordingly.”.

Explanatory Note

This note is not part of the instrument and does not purport to be a legal interpretation.

This Order makes amendments to the First Schedule (as amended) of the Light Railway Order (S.I. No. 59 of 1999) for Luas Line A (Tallaght to Abbey Street) by authorising modifications to the route of the line at the Red Cow Roundabout and associated re-positioning of the Red Cow stop and modification of the ‘park and ride’ facilities. To facilitate these modifications, the Order also extends the period authorised for the carrying out of works on Luas Line A.
