S.I. No. 887/2004 - Health Act 2004 (Commencement) (No. 2) Order 2004


I, MARY HARNEY, T.D., Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the Health Act 2004 (No. 42 of 2004), hereby order as follows:

1.  This Order may be cited as the Health Act 2004 (Commencement) (No. 2) Order 2004.

2.  The 1st day of January 2005 is appointed as the day on which the following provisions of the Health Act 2004 (No. 42 of 2004) come into operation:

(a)  Part 2;

(b)  Part 3 and Schedule 2;

(c)  Part 4 (other than subsections (4) and (5)(a) of section 17);

(d)  Parts 5, 6 and 7 (other than section 37(2)(f));

(e)  Part 8 (other than section 42);

(f)  Part 10 and Schedule 3;

(g) section 73 and Schedule 4;

(h) section 74 and Schedule 5;

(i)  section 75 and Schedule 6, in so far as those provisions relate to the enactments specified in Schedule 6 (other than the Health (Corporate Bodies) Act 1961 );

(j)  section 75 and Schedule 7, in so far as those provisions relate to the enactments specified in Schedule 7;

(k)  Part 12 (other than section 79).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints the 1st day of January 2005 as the date for the coming into operation of Part 2, Part 3 and Schedule 2, Part 4 (other than subsections (4) and (5)(a) of section 17), Parts 5, 6 and 7 (other than section 37(2)(f)), Part 8 (other than section 42), Part 10 and Schedule 3, section 73 and Schedule 4, section 74 and Schedule 5, section 75 and Schedule 6, in so far as those provisions relate to the enactments specified in Schedule 6 (other than the Health (Corporate Bodies) Act 1961 ), section 75 and Schedule 7 in so far as that those provisions relate to the enactments specified in Schedule 7, and Part 12 (other than section 79), of the Health Act 2004 .

The Health Act 2004 provides, inter alia, for the establishment of the Health Service Executive, the consequent dissolution of a number of specified bodies and the transfer of their functions, staff, assets, etc. to the Health Service Executive and the establishment of mechanisms to involve public representatives and users of health and personal social services and other members of the public in matters relating to those services.
