S.I. No. 807/2004 - District Court Districts and Areas (Amendment) and Variation of Hours (District No. 21) Order, 2004

The Courts Service, in exercise of the powers conferred on it by section 26 of the Courts of Justice Act, 1953 (No. 32 of 1953), as amended by section 43 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), section 16 of the Courts Act, 1971 (No. 36 of 1971) and section 29 of the Courts Service Act, 1998 (No. 8 of 1998) and after consultation with the President of the District Court, hereby orders as follows:

1.         (a)  This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Hours (District No. 21) Order, 2004.

(b)    This Order shall come into operation on 1st January, 2005.

2.         The First Schedule to the District Court (Areas) Order, 1961, ( S.I. No. 5 of 1961 ), is hereby amended by -

(a)  the substitution in column (4) of “10.30 a.m.” for “11.00 a.m.” at reference numbers 54, 228, 229, 237, 239, 240, 242 and 243,

(b)  the substitution in column (4) of “10.30 a.m.” for “11.30 a.m.” at reference number 232,

(c)  the substitution at reference number 226 for the matter in column (4) of the following:

“

Cahir —

Second Thursday in February, April, June, October and December at 10.30 a.m.

Fourth Friday in each month at 10.30 a.m.

”,

and

(d)  the substitution at reference number 231 for the matter in column (4) of the following:

“

Clonmel —

Second and Fourth Tuesday in each month at 10.30 a.m.

Third Friday in each month at 10.30 a.m. (Children Court business).

”.

3.         The Second Schedule to the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 ), is hereby amended by -

(a)  the substitution in column (4) of “10.30 a.m.” for “11.00 a.m.” at reference numbers 49, 194A, 196, 197, 205, 206 and 208,

and

(b)  the substitution in column (4) of “10.30 a.m.” for “11.30 a.m.” at reference number 200.

4.         Business transacted in the District Court that is initiated and not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business had been initiated.

EXPLANATORY NOTE

This note does not form part of the instrument and is not a legal interpretation.

This Order provides for-

(a)       the starting time of the sittings of the District Court exercising its summary and civil jurisdictions sitting in the District Court Areas of Cahir, Cappoquin, Carrickon-Suir, Cashel, Clonmel, Dungarvan, Killenaule, Lismore, Tallow, Tipperary and Youghal to be 10.30 a.m.

(b)       The sitting of the District Court in the District Court Area of Cahir which heretofore took place on the Second Thursday in September at 3.00 p.m. to be discontinued.

(c)       The starting times for the sittings of the District Court exercising its summary and civil jurisdiction in the District Court Area of Clonmel on the third Friday in each month to be 10.30 a.m. (Children Court business) and 2.30 p.m. (summary and civil business).
